Lawsuit filed in crash that killed Sugar Grove man
Relatives of a 61-year-old Sugar Grove man who was killed in a car crash earlier this year in Batavia have file a wrongful-death lawsuit.
Survivors of David A. Schele Sr. filed the suit against Craig Schindlbeck of Oswego, accusing him of negligence.
Schele was headed north on Randall Road at about 8:20 p.m. Feb. 15 and was struck by Schindlbeck, who was going south on Randall and in the left turn lane to head east on McKee Street, according to the lawsuit.
“Suddenly and without warning, defendant turned his vehicle into the side of (Schele’s) northbound vehicle, thereby causing a collision to occur and causing injuries so severe to David A. Schele Sr. that he died,” read part of the suit. “As a result, the next of kin of (Schele) have suffered great losses of a personal and pecuniary nature.”
Bernard Weiler, attorney for the Scheles, could not be reached for comment. The suit seeks unspecified damages of more than $50,000 and the two sides are due in court Aug. 29.
According to court records, Batavia police March 22 ticketed the 60-year-old Schindlbeck for failure to yield when turning left.
Schindlbeck has pleaded not guilty to the charges and is scheduled to have a bench trial in Elgin July 2.
Messages left with Frank Giampoli, Schindlbeck’s attorney, were not returned.
