Indianapolis police: Man shot be officer should survive

INDIANAPOLIS (AP) - Indianapolis police say they don't believe a man shot twice during a struggle over an officer's handgun has life-threatening injuries.

Maj. Richard Riddle said Thursday that 50-year-old Gerald Cole was shot in the arm and the back by Officer James Perry during the struggle while Perry was trying to handcuff Cole's brother, 39-year-old Stephen Cole.

The incident occurred Wednesday on the east side while Perry investigated a claim by Stephen Cole's daughter that he had taken her cellphone and debit card.

Riddle say Stephen Cole resisted Perry's attempts to detain him, and the two went to the ground, where Perry tried to handcuff Cole. He says Gerald Cole then came up behind Perry and tried to remove the officer's gun from its holster.

Gerald Cole is hospitalized in serious condition.
