Prosecution on hold in Indiana boy's strangulation death

VINCENNES, Ind. (AP) - Prosecution of a southwestern Indiana man charged with fatally strangling his 5-year-old son is on hold while his defense attorney argues he shouldn't face a possible sentence of life in prison without parole.

Knox County prosecutors filed murder and other charges against 53-year-old Robert Baldwin of Vincennes following Gabriel Baldwin's death in April. Authorities say Baldwin planned the attack for when his other children would be away from home, then choked the boy with a computer cord and sat on him until he stopped breathing.

The Vincennes Sun-Commercial reports defense lawyer Dale Webster has filed court documents claiming Baldwin has an intellectual disability. A county judge has approved the use of county money for mental health and medical evaluations of Baldwin.

Baldwin remains jailed while awaiting trial.
