Lawsuit: City shares responsibility for crash that killed 3

ELKHART, Ind. (AP) - A lawsuit says a northern Indiana city shares responsibility for a crash that killed two children and a man who were walking along a sidewalk.

Authorities say Leonard Grosswiler was driving in August 2017 when his vehicle struck five pedestrians in Elkhart, killing 8-month-old Dolly Thomas, 11-year-old Courtney Smith and 22-year-old Shawn Wolcott. He was sentenced in December to 15 years in the hit-and-run crash, with 10 years to be served in prison.

The Elkhart Truth reports the lawsuit on behalf of the two surviving pedestrians and the families of the dead says Elkhart didn't properly maintain the sidewalk and was aware vehicles had gone over the curb in the area.

Courtney Bearsch, Elkhart director of communications, says attorneys representing the city plan to file "the appropriate legal response."
