Man gets 6 years for drunken crash that killed bicyclist
A man has been sentenced to six years in prison for killing an Elgin bicyclist in a drunk-driving crash.
Anthony Osborne pleaded guilty Wednesday to one count of aggravated driving under the influence of alcohol — causing death.
Authorities said Osborne, 34, of the 500 block of Hickory Place in Elgin, killed Jonathan Herbert, 70, in a head-on crash on Sept. 21, 2023. Herbert suffered a broken leg, face and skull fractures and bleeding on his brain. He died Oct. 4, 2023.
Police followed tire tracks and found Osborne. Prosecutors said at a pretrial detention hearing that Osborne told them he panicked, left, and called his father, who urged him to turn himself in. A defense attorney said Osborne returned to the scene within 15 minutes, while on the phone with a 911 operator.
Police said Osborne had a blood-alcohol level of more than .14, almost twice the legal limit for driving.
Charges of reckless homicide and leaving the scene of an accident — personal injury or death were dropped.
Osborne was given credit for the 590 days he has been detained on electronic home monitoring. He must serve at least 85% of his sentence before being eligible for parole.
