Indiana Supreme Court reverses gang member's conviction

ANDERSON, Ind. (AP) - The Indiana Supreme Court has reversed a gang member's attempted murder conviction stemming from a brutal attack on a rival gang member.

The Herald Bulletin reports (http://bit.ly/1ypMmdp ) that Thursday's ruling reversed 21-year-old Ruben Rosales' conviction in the June 2012 attack.

Justice Steven David wrote in the opinion that Rosales correctly argued that the trial court "committed a fundamental error" by allowing jurors to convict him of attempted murder as an accomplice without the specific intent to kill.

Madison County Prosecutor Rodney Cummings says he'll likely retry the case. He says issues with jury instructions aren't uncommon in criminal cases.

Court documents say Rosales was a 19-year-old member of the Latin Kings gang in Anderson when a disagreement with another gang led to an assault on a 15-year-old gang member.
