Man charged in fatal Elgin nightclub shooting

The man hit by a car as he fled an Elgin shooting last week has been charged with gun and drug offenses, police said today.

Dion Spears, 25, of 9746 S. Princeton Ave., Chicago, was charged with unlawful use of a weapon by a felon, aggravated unlawful use of a weapon, armed violence, unlawful possession of a controlled substance and defiling identification marks on a weapon, all felonies according to Elgin police.

Derrick Bey, 29, was shot and killed Feb. 6 in the parking lot of LaMovida night club.

After the shooting, bystanders wrestled a gun from Spears and he then ran across State Street, where he was struck by a northbound auto, police said.

Spears has been in Sherman Hospital since and is believed to be under a drug-induced coma.

"The warrant for the arrest of Spears hasn't been served yet, at the request of the Kane County State's Attorney's Office, due to his medical condition," Deputy Elgin Police Chief Bob Duffy said Monday.

As Spears was being taken to the hospital, arrested, "He had a small packet of drugs on him, possibly cocaine, heroin or a prescription drug," Elgin Police Lt. Sean Rafferty said.

Spears is on parole after being convicted in 2005 delivery of a controlled substance and possession of a controlled substance.
