Former Waukegan police officer accused of rape, false arrest

A former Waukegan police officer is being accused of rape and false arrest in a federal lawsuit filed by a Chicago woman.

The lawsuit, filed Monday in U.S. District Court, also names the city of Waukegan as a defendant. The lawsuit claims the city was negligent in the training of the officer, who has resigned from the department.

The complaint alleges the woman was stopped by the officer early on January 6. He searched her and placed her in the back seat of his car. The lawsuit claims that while searching her, the officer fondled the plaintiff's chest without her consent.

He then drove to a remote location in Waukegan and had non-consensual sex with her before letting her out to walk home, the complaint states.

Waukegan Police Chief Bill Biang said the plaintiff approached police officials the day after the alleged incident, and the officer, who is not being named because no charges have been filed, was placed on leave the same day. The officer resigned several days later.

The Lake County state's attorney's office is reviewing the alleged incident to determine if criminal charges are warranted
