Charges filed in Elgin nightclub shooting
The man hit by a car as he fled an Elgin shooting last week has been charged with gun and drug offenses, police said Monday.
Dion Spears, 25, of 9746 S. Princeton, Ave., Chicago, was charged with class 3 unlawful use of a weapon by a felon, class 2 aggravated unlawful use weapon, class X armed violence, class 4 possession of a controlled substance and class 3 defacing the identification marks on a firearm, police said.
Derrick Bey, 29, of 417 May St., Elgin, was gunned down at 2:20 a.m. on Feb. 3 in the parking lot of LaMovida night club, 840 N. St. in Elgin.
Police said the club had been rented for a party and witnesses said there was an incident that began in the parking lot about 30 minutes earlier when a woman pushed a man.
Police say they don't know if the incident led to Bey's shooting, but a gun was wrestled from Spears after the shooting. He then fled, running across State Street, and was struck by a northbound auto.
Spears was taken to Sherman Hospital with back injuries and now is in a drug-induced unconsciousness, meant to stop his thrashing around in bed from pain.
"The warrant for Spears arrest hasn't been served yet, at the request of the Kane County state's attorney's office, due to his medical condition," Deputy Elgin Police Chief Bob Duffy said Monday.
Kane County Judge Susan Clancy Boles set Spears' bond at $50,000 on the warrant.
When Spears was arrested, "He had a small packet of drugs on him, possibly cocaine, heroin or a prescription drug," Elgin Police Lt. Sean Rafferty said.
Elgin police remain mum on the motive for the shooting and say their investigation is ongoing.
When Bey was shot, he was on parole on drug and firearm convictions.
Spears also is on parole for August 2005 drug charges when he was caught by police selling cocaine on May Street in Elgin.
