Too late for nightclub owners to complain of theft, judge says
A Cook County judge says the owners of Chicago's E2 nightclub waited too long to allege city employees stole cash and liquor from the club after 21 people died in a stampede there in 2003.
Owners Dwain Kyles and Calvin Hollins Junior alleged last year that they had $110,000 in cash and liquor at the club when the city sealed it for its investigation, and got only $800 back.
But Circuit Judge Kathy Flanagan refused to hold the city in contempt of court on Wednesday, agreeing with city attorneys that the owners were too slow to complain.
Edward Grasse, an attorney for the club owners, says his clients felt they would appear callous if they raised the issue too soon after the tragedy.
