Batavia sues St. Charles driver who hit cop car
The city of Batavia is suing a St. Charles woman accused of causing an accident that left a police officer temporarily unable to work.
The crash happened at 11:49 p.m. Feb. 2, 2008, after Officer Troy Wallace responded to a call for police assistance at Randall Road and Heritage Drive.
According to the lawsuit, Wallace was sitting in a squad car parked along Randall Road with its lights flashing when Urszula Czarnecka, 26, drove into the vehicle.
As a result, the officer "required medical, surgical and hospital care; incurred expenses for the same; was unable to work for a time; and suffered injuries permanently affecting him, and has incurred and will in the future sustain lost wages or lost income and will continue to have economic and noneconomic damages," the lawsuit says.
Czarnecka, who was charged with failure to reduce speed to avoid an accident, received court supervision and was ordered to pay $185 in fines and costs in late February 2008, according to court records.
Her attorney, Robert Newman, declined to comment on the lawsuit Friday, saying he would reserve his remarks for the courtroom.
Batavia is seeking more than $50,000 in damages to cover the officer's worker compensation and disability benefits. The case goes to Judge Stephen Sullivan on Feb. 1, 2010.
