Second boy gets 4 years probation in Naperville sex assault
The second of two Naperville boys was convicted Monday of the aggravated battery of a classmate at Gregory Middle School - a crime that fueled heated debate in Indian Prairie Unit District 204.
The 11-year-old boy was sentenced to four years' probation in Will County juvenile court and must undergo counseling and a sex offender evaluation.
Judge Paula Gomora also ordered him to write an apology letter to the victim, pay $1,500 in restitution for his counseling and barred him from attending the same school or having further contact with the boy and his family.
His co-defendant, 12, received the same sentence after he pleaded guilty last week to a similar felony aggravated battery charge.
The two defendants were accused Nov. 11 of tying up their 11-year-old classmate and sexually assaulting him off campus in one of their homes on Naperville's south side.
Their crime sparked outrage at District 204 board meetings, calls for administrator resignations and proposed changes to state law.
At issue was whether the two defendants, then charged but not convicted, should have been allowed to remain at Gregory Middle School while their cases were pending. One of the defendants voluntarily transferred out of District 204 in February to Lincoln Junior High School in Naperville Unit District 203.
But the other student, whose case was in court Monday, remained at Gregory Middle School until recently. District 204 reached an agreement earlier this month with the boys' families to ensure they do not attend the same schools.
In the pact, the victim will continue to attend Gregory Middle School for two more years and then Neuqua Valley High School. One defendant is remaining in District 203. The other is transferring to Still Middle School after this summer and then, in two years, will attend Waubonsie Valley High School.
