Convicted killer denied new DNA tests
BLOOMINGTON -- A judge says a former Bloomington man convicted of killing his father 18 years ago will not be allowed to have DNA testing on more evidence.
Donald Whalen is serving a 60-year sentence for killing his father, William Whalen, in 1991.
He wanted DNA tests performed on three beer cans, a shot glass, a bar glass and ceiling tile from his father's downtown bar.
But Judge Elizabeth Robb says he's not entitled to have the tests done. She also affirmed her earlier decision to deny WhalenÂ's request for DNA testing on knifes found at the bar.
Whalen's lawyer Jeff Abbott has argued the knives could contain blood from multiple people.
But prosecutors say the test results would be unreliable because of the way the knives were stored.
