Cubs threaten rooftop owner over payments

The Chicago Cubs are suing a rooftop owner for failing to pay for last season's birdseye view of Wrigley Field.

The Cubs on Tuesday filed a breach of contract lawsuit in federal court seeking to bar Anthony Racky from operating the Lakeview Baseball Club he owns until he pays the team 17 percent of his 2008 profits.

Racky has withheld payment in protest of a Jumbotron he claims blocked half his view during the NHL's New Year's Day game between the Chicago Blackhawks and Detroit Red Wings.

Racky has said he intends to withhold the payment until fans who had trouble seeing the rink are given a future discount or freebie paid for by the Cubs.

Cubs vice president Mike Lufrano is calling the dispute with Racky unfortunate.
