Man charged with sexually assaulting a woman who thought he was her Uber driver
A Chicago man is accused of sexually assaulting a woman who believed he was her Uber driver in Elmhurst Thursday.
Jose Cornelio Evaristo, 42, has been charged with two felony counts of criminal sexual assault of a person unable to consent and two counts of misdemeanor driving under the influence.
A DuPage County judge ordered Cornelio Evaristo to be detained pretrial.
Following an investigation, authorities learned that the woman had taken a train to Chicago to attend a concert. At some point in time, she ordered an Uber to get home and subsequently got into Cornelio Evaristo’s vehicle, thinking he was the Uber she had ordered, according to the DuPage state’s attorney’s office.
Authorities alleged that Cornelio Evaristo stopped his vehicle on Route 83 in Elmhurst and sexually assaulted the woman. Authorities also alleged that Cornelio Evaristo had a blood alcohol content of .08 at the time of his arrest.
His next court appearance is set for May 18.
