ICE officer charged with DUI in Oak Brook
A federal immigration agent has been charged with driving drunk in Oak Brook, while going home after working at the ICE detention facility in Broadview.
It happened when a Westmont police officer noticed a man asleep at the wheel around 1:38 a.m. Oct. 26, at a traffic light at 35th Street and Midwest Road, police say.
When the officer knocked on Guillermo Diaz-Torres’ window, Diaz-Torres drove across the T-intersection and into a row of hedges, on the Oak Brook side of the intersection, according to an Oak Brook police report.
As an Oak Brook officer approaches the scene, the Westmont officer said “Oh, this is a fun one. It gets better,” as he handed over Diaz-Torres’ identification. The Oak Brook officer then asked if Diaz-Torres is intoxicated, and the Westmont officer nodded “yes.” “As soon as you walk up, you’ll catch it,” the Westmont officer said.
Diaz-Torres told an Oak Brook officer he was driving back to a hotel in Lombard after working an 18-hour shift that ended at midnight. Torres. 33, lives in Albuquerque, New Mexico, according to a police report.
The hotel is about 10 miles from Broadview. When the officer asked why he was still driving 90 minutes after his shift, Diaz-Torres said he was not familiar with the area and usually relied on GPS for directions.
“You guys have a checkpoint. This doesn’t look good at all,” Diaz-Torres said, according to a body-camera video and police report.
There was no checkpoint.
The police report says Diaz-Torres failed several sobriety tests and refused to take a breath test. It says he had bloodshot, glassy eyes, and that the officer smelled alcohol.
He is charged with one misdemeanor count of driving under the influence of alcohol.
Because he refused to take a breath-alcohol test, police have requested a summary suspension of his driver’s license.
Diaz-Torres is charged with misdemeanor driving under the influence of alcohol and was released with a notice to appear. His supervisor picked him up, according to the report.
A spokesman for ICE has not responded to a request for comment.
He is due to appear in DuPage County Circuit Court Dec. 5.
