A wartime issue?

There is a matter I have not heard discussed on any media sources. I am not a lawyer and would like to find a reply from a lawyer practicing in international or similar practice.

1. Trump invoked wartime powers to declare a foreign invasion.

2. The Department of Defense dispatched U.S. military troops to urban areas.

3. Advisor Stephen Miller referred to the immigrants as foreign invaders not entitled to due process.

Is it now the subject of control and process subject to the terms of the Geneva Conventions? Can Tom Homan and Kristie (I can't even protect my own purse) Noem and others be branded as war criminals?
