Judge orders Democrat on ballot for York supervisor

A judge has ordered a Lombard man’s name be put on the April 1 ballot for the York Township supervisor election.

Timothy M. Murray, a Democrat, sought the court order after York Township Clerk Anthony Cuzzone refused to certify Murray as a candidate.

DuPage County Judge Anne Therieau Hayes granted Murray’s request Thursday, ordering Cuzzone to certify Murray’s nomination and the DuPage County clerk to list Murray on the ballot.

At a caucus in December, township Democrats nominated a person to run for supervisor. That person later withdrew from the race. In early January, township party officials nominated Murray as a replacement.

Cuzzone argued the nomination didn’t comply with state law. In a reply to Murray’s petition, Cuzzone contended that the committee did not have the authority to pick a replacement, that the nomination was filed too late, and that Murray filed the wrong statement of candidacy form.

Cuzzone is a Republican seeking re-election. Supervisor John Valle, also a Republican, is seeking re-election.
