North Aurora man pleads guilty in DUI crash that killed motorcyclist in Batavia last year

A North Aurora man has pleaded guilty to a DUI crash that killed a motorcyclist in Batavia last year and will be sentenced to eight years in prison.

Luis Aca Osorio, 40, of the 100 block of Dee Road, agreed to the sentence and the guilty charge of aggravated driving under the influence of alcohol causing death, a felony.

The Kane County state’s attorney’s office said that Aca Osorio was driving a van in Batavia on May 7, 2023, at about 5:15 p.m. when he rear-ended a motorcyclist.

Aca Osorio stopped nearby and was located by police officers who believed him to be impaired. A breath test test showed his blood-alcohol level to be .204.

The driver of the motorcycle died as a result of the injuries he suffered in the crash.

Under state law, Aca Osorio must serve 85% of his sentence. The sentencing range for the offense is three to 14 years in prison.
