CMC Materials wins patent dispute with DuPont
AURORA - CMC Materials Inc. Wednesday said a final review has affirmed an earlier decision in CMC's patent infringement case against de Nemours Inc. and several DuPont subsidiaries.
As announced in December, the International Trade Commission found DuPont is unlawfully importing, selling and marketing in the U.S. certain chemical mechanical planarization slurries and components thereof that infringe on a patent owned by CMC.
CMC is a leading global supplier of slurries and consumable materials primarily used by semiconductor manufacturers.
Now that the review period has expired, United States Customs and Border Protection will stop the importation into the U.S. of DuPont's infringing Optiplane 2300 and Optiplane 2600 slurries and components until 2035 - the expiration date of CMC's patent, the company said.
Under the December Final Determination, a company expecting to "transition away" from the infringing products in the short term must submit to the customs department a "documented need" for the products under penalty of criminal sanction.
