Kane judge rules man who sexually assaulted children to be sexually violent person
A Kane County judge has found that a registered sex offender convicted of assaulting multiple children is a sexually violent person, authorities said.
Judge Alice Tracy has ordered Kerby Ford, 57, to remain in the custody of the Illinois Department of Human Services for treatment. He will be returned to the IDHS Treatment and Detention Facility in Rushville, according to a news release from the Illinois attorney general's office.
In 2008, Ford was sentenced to four years in prison for sexually abusing a 13-year-old girl in Kane County. At the time, he was living in Aurora and working in a restaurant owned by the girl's uncle.
In 1993, Ford was sentenced in Cook County to nine years in prison for sexually assaulting two girls, ages 8 and 9, whom he was babysitting, according to the news release.
Also in 1993, he was sentenced to nine years in prison for sexually assaulting two other girls, under the age of 13, when he was babysitting them in 1989 in Kane County.
To be committed under the Sexually Violent Persons Commitment Act, a person must have been convicted of a sexually violent offense and suffer from a mental disorder. Prosecutors also have to prove the person is likely to commit more acts of sexual violence if released from custody. Once committed, periodic re-evaluations occur, to see if they still meet the criteria.
The attorney general filed the SVP case in 2010.
