Aurora man charged with reckless homicide, DUI after one killed in crash

A 35-year-old Aurora man has been charged with reckless homicide after a crash Sunday killed a passenger in his vehicle.

Gustavo Gutierrez-Aguilar, of the 0-100 block of Margarets Lane, was drunk when he lost control of his car and struck a tree at Mountain Street and Austin Avenue, Aurora police said in a news release.

The crash happened around 6:15 p.m. Police say they found Gutierrez-Aguilar outside the vehicle. He was having trouble walking and maintaining his balance, and an officer could smell alcohol on his breath, police said.

The passenger, 29-year-old Lazaro Rosas-Garcia, was unconscious and not breathing inside the car. He was pronounced dead at a hospital.

Gutierrez-Aguilar has been charged with one count of reckless homicide and six felony counts of aggravated DUI.

Gutierrez-Aguilar is being held at the Kane County jail on $500,000 bail. He would need to post $50,000 bail to be released. His next court date is Thursday.

According to a GoFundMe.com account organized to pay for his funeral expenses, Rosas-Garcia is survived by a wife and four children.
