Elgin man charged with aggravated stalking, harassment
A 30-year-old man is in custody after his arrest this week on charges he stalked an Elgin woman.
David Rodriguez Jr., whom court records list as homeless, is charged with aggravated stalking/violating an order of protection, two counts of stalking, two counts of violation of an order of protection and three counts of harassment, according to Kane County court records. He also had two pending cases on misdemeanor charges of violation of an order of protection from 2019 at the time of his arrest, according to court records.
Rodriguez was arrested Wednesday morning at a hotel in Elk Grove Village.
According to a search warrant in which authorities sought his activity on Instagram and charging documents, Rodriguez sent eight messages to his ex-girlfriend and her brother, saying he had people watching her house. He accused her of cheating, demanded they drop the arrest warrant, and wrote "I'm not turning myself in until I accomplish a few things," authorities allege.
The 30-year-old woman had obtained an order of protection against Rodriguez in October 2019. That order also covered her four children from a previous relationship, ranging in age from 6 to 13, court records show.
Rodriguez was charged in October 2019 and November 2019 with misdemeanor violations of an order of protection, court records show. He was accused of sending the woman text messages and communicating with her over the Talking Parents app about subjects not involving their daughter in common, who is now about 1½ years old.
Rodriguez also was arrested in mid-November on a felony charge of harassment through electronic communications, records show.
He is being held on $199,000 bail at the Kane County jail. If he posts $19,900 bond to be released while the case is pending, he is to have no contact with the woman or her family and stay away from her residence.
He is next due in court Wednesday. He faces a sentence ranging from probation to up to five years in prison if convicted of aggravated stalking.
