Man, attacker killed in Chicago gunfight, third man charged

CHICAGO (AP) - A man on probation for a gun violation was charged Tuesday with murder for taking part in a Chicago gun battle that left two dead.

Marlow Rainey, 20, is being held without bond for his role in the fatal shooting of a concealed-carry holder. Authorities say Elvis Garcia, 39, was in front of his South Side home Sunday talking to a neighbor when Rainey and 17-year-old Michael Portis, 17, approached them and Portis opened fire.

Garcia was fatally wounded, but was able to return fire, wounding Portis. The neighbor, who ran, was wounded in the arm.

Cook County prosecutors say Rainey, who is facing first-degree murder and attempted murder charges, was shot twice during the exchange of gunfire.

Garcia was pronounced dead at University of Chicago Medical Center and Portis was pronounced dead at the scene of the shooting.

Prosecutors say Rainey, who fled in an SUV he and Portis drove to the shooting scene, went to a nearby hospital, where his wounds are being treated. He didn't attend Tuesday's bond hearing before Cook County Circuit Judge Susanna Ortiz.

It wasn't immediately known if Rainey has legal representation.
