Widow takes step toward suing over husband's police shooting

LINDEN, Ind. (AP) - The widow of a man fatally shot by a state trooper along a western Indiana highway has taken a step toward filing a civil lawsuit.

Gloria Rightsell's attorney recently filed a tort claim signaling she may sue over 56-year-old Glenn Rightsell's death.

The Journal & Courier reports the notice gives government agencies, including Indiana State Police, 90 days' notice before they can be sued.

Police say Trooper Daniel Organ shot Rightsell on Dec. 28 after he failed to follow his orders and grabbed a handgun on his own waist.

Organ had stopped along U.S. 231, about 40 miles northwest of Indianapolis, to investigate a vehicle parked in front of an abandoned SUV.

Rightsell's relatives say he was working on his daughter's stalled SUV and he always carried a belted gun.
