Elgin man gets almost 11 years in prison for sexually assaulting girl
A former Elgin man has been sentenced to 10 years and 10 months in prison after pleading guilty to sexually assaulting a girl he knew in 2014.
Cesar M. Calderon, 37, formerly of the 500 block of Center Street, was charged in October 2016 with two counts each of predatory criminal sexual assault of a child under 13 and aggravated criminal sexual abuse of a child under 13.
At the time of the 2016 charges, Calderon was serving a 4½-year prison term after pleading guilty to possession of a firearm by a felon after a Dec. 29, 2014 arrest in Elgin.
Calderon, who has now completed his sentence for the weapons offense, was set for a jury trial this week in Kane County on the latest charges but instead pleaded guilty Friday to one count of predatory criminal sexual assault. That charge accused him of sexually assaulting the girl between Jan. 1, 2014 through Dec. 31, 2014, according to Kane County court records.
Kane County Judge D.J. Tegeler accepted the plea, in which prosecutors dismissed the remaining charges, records show. Calderon faced a punishment of six to 30 years in prison on the charge, and had the case gone to trial, he faced up to 60 years in prison if convicted of all charges.
Calderon also must: register as a sex offender for the rest of his life; pay $1,130 in fines and fees; and is to have no contact with a 17-year-old man and four minors, including the victim, ranging in age from 11 to less than 1-year-old, through June 2031, according to court records.
Under state law, Calderon must serve 85 percent, or a little more than nine years of his prison term, instead of the customary 50 percent for many crimes. He also gets credit for 883 days served while the case was pending.
