Authorities: Gang members pointed loaded gun at pedestrian in Elgin
Two gang members were charged after pointing a loaded gun from their vehicle at a pedestrian Feb. 10 in Elgin, according to a news release from the Kane County state's attorney's office.
Freddy Garcia, a 24-year-old Elgin resident, and Antony A. Oliva, a 22-year-old St. Charles resident, were both charged with possession of a firearm by a street gang member, aggravated unlawful use of a weapon and aggravated assault, the release said. Oliva was also charged for driving under the influence.
Around 9:30 p.m., Oliva was driving on the 600 block of Villa Street with Garcia as a passenger when they spotted the victim walking in a business parking lot, according to the release.
Garcia, of the 600 block of Packard Drive, pointed a loaded .22-caliber handgun at the victim as they drove past, the release said. Oliva, of the 1800 block of Riverside Drive, circled the block so the pair could take another pass at the victim with Garcia pointing the gun a second time, authorities said.
Each faces a minimum sentence of three years' imprisonment if convicted. They remain at the Kane County jail.
Garcia's next court appearance is scheduled for 9 a.m. Friday and Oliva's is scheduled for 9 a.m. March 7.
