Indiana man returned to prison for 3 years in DUI fatality

GOSHEN, Ind. (AP) - A northern Indiana man who pleaded guilty in a 2008 drunken-driving crash that killed a pregnant woman has been returned to prison for three years for violating his probation.

An Elkhart County judge sentenced 57-year-old Jon Hicks on Thursday after ruling that he broke the terms of his probation by consuming alcohol.

The Elkhart Truth reports that Hicks was originally sentenced to 18 years in prison, with three years suspended, after pleading guilty to drunken driving and involuntary manslaughter charges in 22-year-old Sara Martinez's February 2008 death.

He was released on probation in 2016, but was accused of violating probation by testing positive for alcohol last June.

Prosecutors argued that house arrest wouldn't be appropriate for Hicks because he's a danger to the community and could get access to alcohol.
