Hearing delayed on District 54 marijuana lawsuit

The next court hearing in a federal lawsuit over an 11-year-old girl's request to take prescribed medical marijuana at her Schaumburg Township Elementary District 54 school has been delayed from Wednesday to April 26.

A negotiated agreement will remain in place allowing her school in Hanover Park to administer the drug without fear of prosecution by the Illinois attorney general.

The girl's parents, Jim and Maureen Surin, sued District 54 earlier this month for refusing to administer the drug. The district said doing so on school grounds was prohibited by state law.

The Surins argued the ban is unconstitutional under the 14th Amendment guaranteeing due process, and that there isn't a rational basis for the distinction between where medical marijuana is allowed and school property.
