Man charged with 5th DUI after sleeping on I-88 shoulder

A DeKalb man was charged over the weekend with his fifth DUI after authorities found him sleeping on the shoulder of Interstate 88 in Aurora Township with a spilled drink on his passenger seat.

Alberto Segura, 46, of the 300 block of Cloverleaf Court, is charged with aggravated DUI, aggravated DUI with a blood alcohol concentration of .16 or greater, driving while license revoked, no insurance and transportation of open alcohol, according to Kane County court records.

A passing motorist notified authorities Sunday night of a man sleeping in his car on the eastbound I-88 shoulder, according to an Illinois State Police report.

The responding officer found Segura, who had four previous DUI arrests, sleeping in his 2007 Hyundai at about 7:10 p.m. The officer "arrived and observed the driver was asleep and an open alcohol bottle was spilled on the passenger seat," part of the report read.

Segura had slurred speech, reeked of alcohol and failed field sobriety tests, according to the report. A breath test showed a BAC of .28, which is more than three times the legal threshold of .08., the report said.

Additional information about Segura's previous DUI arrests was not immediately available but occurred in Kane County before Sunday's arrest, records show.

Segura was being held on $100,000 bail, and is next due in court Friday. If convicted of the most severe felony, Segura faces a punishment of up to 15 years in prison.
