Indiana Supreme Court delays hearing in intruder shot case

ELKHART, Ind. (AP) - The Indiana Supreme Court has delayed a hearing on the appeal of three Elkhart men convicted of murder after an accomplice was fatally shot by a homeowner during a break-in.

The court was scheduled to hear arguments in the appeal of Blake Layman, Levi Sparks and Anthony Sharp on Jan. 21, but rescheduled it for Feb. 26.

The Elkhart Truth reports (http://bit.ly/1znbh1j ) the men's attorneys will have 20 minutes to explain why the court should toss out their felony murder convictions or lessen their sentences.

The trio was convicted in the October 2012 shooting death of 21-year-old Danzele Johnson.

Johnson was fatally shot by a homeowner after the four youths broke into his home. State law allows murder charges if someone is killed during the commission of another felony offense.
