Something was wrong with this picture

The large picture in the top half of the Jan. 1 front page, I’m certain, was meant to convey the snowy and extremely cold conditions many of my friends and neighbors had to contend with on Monday morning. However, this photo showed a man crossing the railroad tracks while the gates on both sides of him are down. I believe this is illegal. Or is it OK when a photographer is present?
