Hearing delayed:
The final motion scheduled to be heard at the local court level in the 2009 murder of a toddler at a Lincolnshire day care center was delayed Friday in Lake County Circuit Court. Lawyers for Melissa Calusinski, 25, had been set to argue the 31-year prison sentence she received for killing 16-month-old Benjamin Kingan should be reduced, the last procedural step before filling an appeal of the Carpentersville woman’s conviction and sentence. But Circuit Judge Daniel Shanes told attorneys on both sides that background information on a defense witness subpoenaed by the defense had been received by his office and there would have to be a hearing on the relevance of that material prior to the motion to reconsider. He ordered the parties to return to court March 29 for continued proceedings. Calusinski was not present in court Friday as she has already been transferred to the state prison system.
