South Elgin man guilty of resisting police

A 37-year-old South Elgin man accused of fighting with police and trying to disarm an officer has pleaded guilty to lesser charges and will receive two years probation and community service.

Jeff Schultz originally faced felony charges of attempted disarming of a police officer and aggravated battery to a police officer after police were called at 3:30 a.m. Jan. 31, 2010, to his home in the 1100 block of Sunbury Road because Schultz was fighting with his son.

The most serious felony charges carried a three- to seven-year prison term.

Police said Schultz punched an officer in the face, pushed another into a wall and tried to pull a gun out of an officer’s holster.

It was not the first time Schultz was accused of scuffling with police. According to court records, he was arrested in 2005 for resisting arrest and got six months supervision.

Under a plea agreement accepted by Kane County Judge Timothy Sheldon, the felony charges were dismissed and Schultz pleaded guilty to misdemeanor resisting arrest and was fined $850.

Schultz will be on probation for two years, must complete 100 hours of community service and undergo drug and alcohol counseling. If he fails to comply, he could get a 180-day sentence in the Kane County jail.

Garrett Malcolm, Schultz’s attorney, did not respond to phone messages.

Schultz also faces misdemeanor attempted aggravated assault charges from a Feb. 6, 2012, case in South Elgin and is due in court on that case on March 26, according to court records.
