Elgin sues golf course caterer for back rent

Porter's Pub at Elgin's Bowes Creek Golf Course is open for business, but the city is suing a company it initially contracted with to run the restaurant.

The city seeks more than $66,000 in back rent plus interest from Twelfth Night Catering in a lawsuit recently filed in Kane County.

The suit alleges a breach of contract by the Huntley-based company, which the city contracted with in fall 2009 to operate the new restaurant, provide catering and banquets along with on-course beverage services at the 18-hole course on the city's far southwest side.

As part of the three-year agreement, Twelfth Night was to give the city 2.5 percent of any gross receipts that topped $1 million or 5 percent of receipts more than $1.75 million, the suit states.

The suit also states that Twelfth Night was to provide the city with monthly and annual reports, but did not, and therefore a complete accounting is needed to determine if Twelfth Night owes more than just back rent.

“(They) went out of business. We terminated the lease. We have a new operator there,” said Elgin Corporation Counsel William Cogley.

Porter's Pub has been operated and managed by the Downers Grove-based Carlucci Hospitality since June 2011.

The city and Twelfth Night representatives, who could not be reached for comment, are due in court on March 8.
