Elgin man gets 13 years for shooting at cops

An Elgin man was sentenced to 13 years in prison Tuesday after pleading guilty to shooting at police in July 2009.

Victor Nava, 23, of the 500 block of Trinity Terrace, must serve 85 percent of his sentence for reckless discharge of a firearm. He will get credit for about two years in jail since his arrest and will be on parole for three years.

He faced up to 45 years in prison for the felony charge.

Kane County Judge Edward Schreiber accepted the plea in which prosecutors dropped charges of attempted murder and unrelated probation violations stemming from 2006.

“It is a lot of time but we think it was a fair outcome considering the circumstances,” said defense attorney Scott Frankel, who noted Nava has earned his GED and is determined to turn his life around. “It was an unfortunate incident. He certainly regrets being out there that night.”

Kane County Assistant State’s Attorney Kelly Orland said Elgin police were called to North Spring Street and Second Street in the early morning hours of July 11, 2009, to investigate a disturbance.

Orland said a uniformed officer with a flashlight spotted Nava in the 300 block of North Spring and Nava fired a single shot at the officer and missed.

Nava, who was 21 at the time, was chased and captured nearby; officers found a 9 mm handgun and shell casing nearby.

No one was injured in the attack.
