Wheeling company settles pollution case

WICHITA, Kan. — The Orval Kent Food Co. has agreed to pay a $390,000 civil fine to settle allegations of water pollution from its processing plant in the southeast Kansas town of Baxter Springs.

The U.S. Environmental Protection Agency announced the agreement with the Wheeling-based company Monday. That's the same day the Justice Department filed suit seeking an injunction ordering Orval Kent to stop violating the Clean Water Act.

The Kansas plant makes prepared salads, such as cole slaw and potato salad.

The consent agreement also requires the firm to spend at least $32,500 to restock fish in the Spring River.

Residents had complained about odors and reports of raw sewage floating downstream into Oklahoma. The Eastern Shawnee Tribe of Oklahoma has also complained about sewage floating into its territory.
