Riverside Square demolition lawsuit inches ahead

The village of Algonquin’s lawsuit seeking a court-ordered demolition of the partially-built Riverside Square development is slowly making its way through the court system.

On Friday, McHenry County Judge Michael Sullivan sided with the village on a couple of issues raised by the defendants, including finding that the village properly notified the bank before filing the lawsuit last March, said Algonquin Village Attorney Kelly Cahill. The defendants are Amcore Bank, now owned by Harris Bank, and several lien-holders for the property.

Judge Sullivan also set a few deadlines for the discovery process, and set another status hearing in 90 days. “We are hoping that at the next status hearing we’ll get a trial date,” said Russ Farnum, the village’s community development director.

Meanwhile, a separate case involving a court-ordered auction of Riverside Square will be in court March 3.
