Koldos kept off Elgin council ballot
The April 5 ballot for Elgin City Council will have 10 candidates instead of 11 as a Kane County judge Thursday afternoon denied a move by David Koldos to stay on the ballot.
Koldos sued the city and City Clerk Diane Robertson after she refused to certify Koldos' nomination petitions to run for one of three, 4-year council seats.
Mike Gehrman, Elgin's assistant corporation counsel, sought to have the lawsuit dismissed.
Gehrman argued that Koldos failed to fill out and file a statement of economic interest with the Kane County Clerk by the Nov. 22 deadline.
Gehrman also noted that Koldos, who was acting as his own attorney, even admitted in his own lawsuit that he filled out the required form a day after the deadline.
“(Koldos) has clearly not conformed to the statutory filing requirement,” Gehrman said.
Koldos contended that the actual deadline to file the form was Dec. 20 because there were not enough candidates in Elgin to trigger a primary election in February.
Judge Robert Mueller agreed with Gehrman and tossed Koldos' suit.
Koldos said he will explore whether to appeal Mueller's ruling and whether to run as a write-in candidate.
“I was hoping things would go better Thursday,” he said after the ruling.
