Elgin man faces deportation after burglary, sex charges
A 19-year-old Elgin man who was accused of a January sex attack could be deported after pleading guilty this week to a lesser charge and an unrelated burglary.
Victor J. Ocampo, of the 400 block of Ann Street, was sentenced to three years probation and fined a total of $2,374 after pleading guilty to a February burglary at Bennigan's, 495 Airport Road, Elgin, and misdemeanor sex abuse.
Police had said Ocampo, an illegal Mexigan immigrant, put a gun to the head of a 15-year-old girl and forced her to have sex with him at her Elgin home during the early hours of Jan. 30.
Ocampo also must register as a sex offender for at least the next 10 years. He was sentenced to 167 days in jail but given credit for 167 days served in jail since his June arrest.
But that doesn't mean Ocampo will go free.
The U.S. Department of Immigration and Customs Enforcement has placed a hold on Ocampo for when he is released from the Kane County jail.
ICE spokeswoman Gail Montenegro said she could not comment specifically on Ocampo's case, but noted that an “ICE hold” generally means local authorities must turn a person over to ICE after a person's sentence is done.
From there, a defendant must go before federal deportation court for a hearing.
As of late Thursday, the Kane County jail still had custody but Ocampo was expected to be turned over to ICE soon.
Ocampo was intially charged with five counts of aggravated criminal sexual abuse, two counts of criminal sexual assault, two counts of criminal sexual abuse and one count of sex abuse, a misdemeanor.
All but the misdemeanor charged were dropped in exchange for the guilty plea.
