No charges expected in St. Charles fatal accident
No charges will be filed at this time in the death of a St. Charles woman who was struck and killed Friday morning by a dump truck as she pushed her bicycle across the street.
The Kane County State's Attorney's office reviewed evidence in the death of Arlene "Kay" Marshall and decided the driver won't be charged, according to Sgt. Brad Griffin of the St. Charles Police Department.
"There were no driver issues that we noticed," Griffin said Saturday. "I don't know that there won't be in the future, but as of right now, no charges (are) to be filed."
Marshall, 68, was struck about 7:20 a.m. Friday while crossing West Main Street/Route 64 where it intersects with North 2nd Street/Route 31 in St. Charles. She was a resident of Carroll Towers, a retirement community about a block away from the accident scene.
The evidence that police presented to the state's attorney's office included red-light camera footage, witness statements and physical evidence, Griffin said. It was determined the driver wasn't intoxicated.
Meanwhile, funeral services for Marshall are scheduled for Wednesday.
In Marshall's obituary, family members said the St. Charles High School graduate and longtime resident of the city "rode her bicycle throughout the area for everything she did and in all kinds of weather."
They also said that three children in the family have been named after her.
She was retired after employment that included The Little Traveler in Geneva, Baker Hotel in St. Charles and the Kensington School of Geneva.
As a member of Baker Memorial United Methodist Church in St. Charles, Marshall sang in the choir and was recognized for 25 years of teaching Sunday school.
"She touched the lives of so many children," said the notice. "Kay was known for her kind, compassionate heart."
Marshall's hobbies included collecting Madame Alexander dolls and Disney movies that she could share with her nieces and nephews.
She also enjoyed activities with the St. Charles Park District Senior group.
Visitation will start 9:30 a.m. Wednesday, Aug. 11, at Baker Memorial United Methodist Church, 307 Cedar Ave., St. Charles, followed by an 11:30 a.m. service at the church. Burial will be at Union Cemetery in St. Charles. Moss-Norris Funeral Home in St. Charles is handling arrangements.
