St. Charles man trying to defraud urine test

A St. Charles man has been charged with attempting to defraud a drug and alcohol screening test required for his probation, according to police.

Scott A. Gardner, 18, of the 41W800 block of Empire Road, reported to the Kane County probation office Monday. Staff checked his name through the county's criminal records database, as is customary, and discovered he was wanted on a warrant in connection with a charge of battery. He was then arrested by sheriff's deputies.

While being searched in a holding cell, deputies discovered Gardner was wearing a Whizzinator under his pants.

The device consists of a plastic pouch, attached to a prosthetic penis. The pouch was filled with urine. Deputies say Gardner admitted the urine was not his, but a friend's. He told them he bought the device online for $300.

Gardner is on probation on a possession of marijuana conviction.

The defrauding charge is a misdemeanor, not a felony, because he had not been asked to supply a sample, and therefore had not used it, before he was arrested on the warrant.
