Scott Fawell should look in the mirror
Scott Fawell was right about one thing in his letter. I have no compassion for the situation in which he found himself. He violated the public trust. He broke the law. He is also misinformed. One of his arguments is that if the government had enough evidence to indict, then it already has enough evidence to convict. Why did they need him? Unless I'm mistaken, I believe a grand jury returns an indictment when there is probable cause a crime has been committed. However, once the case is brought to trial, conviction only occurs if the person if found guilty beyond a reasonable doubt. In my mind, there is a fairly wide gap between probable cause and beyond a reasonable doubt. While I am sure the situations Mr. Fawell and Mr. Kelly found themselves in were indeed extremely difficult, they only had to look in the mirror to see who to blame.
