Police: Elgin man admits to sexually assaulting passed out woman
An Elgin man has admitted he raped a 23-year-old woman while she was passed out at a Monday morning party on the city's far west side, police said.
Carlos A. Lopez, 28, of the 700 block of Adams Street, is charged with criminal sexual assault, a Class 1 felony that carries up to 15 years in prison and fines of up to $25,000 if convicted, police said.
At 2:50 a.m. Monday police were called to the 3000 block of Seekonk Avenue. Court documents said the woman, who drank enough alcohol to the point she vomited, had passed out on a couch. When the woman woke she found Lopez sexually assaulting her.
A witness pulled Lopez off the woman several minutes later and said it was clear she was not awake during most of the encounter, documents said.
The woman told police she did not know Lopez and never gave him permission to have sex with her.
Lopez waived his Miranda rights and admitted to having sex with the woman while she was sleeping, and said he did so without asking her, documents said.
Kane County Judge John A. Noverini set Lopez's bond at $10,000 Tuesday and issued him a July 20 court date at the Kane County Judicial Center. Lopez also must pay a $5,000 full cash bond for an unrelated DUI warrant, Noverini said. His court date on the DUI warrant is July 14.
Lopez was being held at the Kane County lockup Tuesday.
