Comedian Schimmel won't face assault charges

LOS ANGELES -- Prosecutors in California say the wife of standup comic Robert Schimmel has declined to press assault charges against him.

Deputy District Attorney James Garrison also wrote in a charge evaluation worksheet filed Thursday that there was not enough evidence to charge the 59-year-old.

Schimmel was arrested on suspicion of assaulting his wife on May 2 at his Calabasas home. She later filed for divorce.

The comedian has been a frequent guest on "Late Night with Conan O'Brien" and on Howard Stern's radio show. His 2008 memoir, "Cancer on $5 a Day," chronicles his battle with non-Hodgkin's lymphoma.
