Homeowners ask judge to reconsider Wal-Mart ruling
A group of West Dundee homeowners that last month lost a legal battle to block a Wal-Mart development in the village are asking a Kane County judge to reconsider his ruling.
Lisa Geisler, one of seven plaintiffs named in the suit, said in a statement Tuesday there are issues the judge may have overlooked in his decision to allow a 186,000-square-foot Wal-Mart Supercenter to be built on the outskirts of Spring Hill Mall.
Specifically, the plaintiffs want Judge Michael Cowell to consider the bankruptcy filing of Chicago-based General Growth Properties, which owns the mall and the proposed Wal-Mart site at Huntley Road and Elm Avenue. The property owner also is named as a defendant in the case.
In April, Cowell granted the village a motion to dismiss the case in which residents claimed West Dundee officials failed to follow their own ordinances when it approved zoning variations for the store.
