Judge: Foxfield stays in Campton Hills
A Kane County judge has rejected a petition to disconnect a 100-home subdivision from the village of Campton Hills, officials said Wednesday. Judge Michael J. Colwell delivered the ruling regarding the Foxfield neighborhood Tuesday in Kane County Civil Court.
Village officials said the disconnection couldn't proceed because it would result in another piece of village property being left alone in unincorporated Kane County.
"It would be sticking out there, not connected to the village at all," Village Attorney Bill Braithwaite said.
Attorney Timothy Elliott, who represented Foxfield property owners in the case, could not immediately be reached for comment Wednesday. He previously suggested the village annexed the outlying property to prevent the disconnection from taking place because it would interrupt the village's congruity.
The outlying property was annexed by the village board at a December meeting that is now the subject of an open meetings complaint filed by a Foxfield homeowner who says the board didn't appropriately notify the public.
Hal Morris, who also represents the village, said the complaint is still pending but that Colwell indicated in court Wednesday that he "did not find any violation of the Open Meetings Act."
Foxfield consists of 106 parcels, five of which are undeveloped, Morris said. The disconnection petition was one of several filed after the village's controversial incorporation about two years ago.
