Elgin man charged with rape

Police arrested a 46-year-old Elgin man Thursday for the rape of a 25-year-old Glendale Heights woman in his apartment Tuesday morning.

Victor Vargas, was charged in court Friday with three counts of criminal sexual assault, police said.

The woman told police she had been sleeping around 6 or 7 a.m. Tuesday when she awoke and found Vargas having sex with her.

She told police she didn't give her consent. She identified him from a photo lineup at the police station.

Vargas told police he came home from work Tuesday and found the woman lying naked in his bed. He said she was not supposed to be there. Vargas admitted a sex act took place but stated she consented to it.

Police said Vargas and the woman had common friends but did not know if they were previously acquainted with one another. No other information was available.

Vargas was unable to post a $15,000 bond and was transported to the Kane County jail Friday. His next court appearance is scheduled for March 5 at the Kane County Judicial Center.
