Kane preserve sued over child who climbed on hot coals

A lawsuit has been filed against the Kane County Forest Preserve District over a family picnic that ended with a toddler climbing into a bin full of hot coals.

The child, then 2 years old, had been playing on a jungle gym at the Buffalo Park campgrounds south of Algonquin Aug. 4, 2002 when she climbed into a nearby container for discarded barbeque coals, according to the two-count lawsuit filed Monday in Kane County Circuit Court.

The suit claims Kane County and the forest preserve district put an open "hazardous materials container" in an area frequented by children and failed to post warnings written in English and Spanish. It seeks unspecified damages for medical bills and legal costs.

Neither the child's mother, plaintiff Annel Segura of Chicago, nor her attorney could be reached for comment Wednesday. The lawsuit does not address the girl's injuries.

A spokesperson for the forest preserve district referred comment to an attorney, who could not immediately be reached.
