Man convicted in attempted murder case attacks officer

A man convicted of attempted murder and armed robbery last week attacked a Lake County jail corrections officer just a short time after the verdict was handed down, officials said Monday.

Kavin Spivey, 29, is already facing a minimum of 26 years in prison for robbing a woman of her wallet in Gurnee and then shooting at a man who chased him last Nov. 30.

Circuit Judge Fred Foreman found Spivey, of downstate St. Anne, guilty of attempted murder, armed robbery, armed violence, aggravated discharge of a firearm and other offenses Sept. 11 after a three-day trial.

Assistant State's Attorney Michael Mermel said Monday that Spivey became disruptive as he was being brought back to the jail from Foreman's courtroom.

Spivey was cursing at corrections officers and telling them he did not care how he acted because he had been found guilty, Mermel said.

Once back at the jail, Officer Dennis Miller ordered Spivey to return to his cell and Spivey refused, Mermel said, then turned on Miller and struck him several times in the head, chest and upper body.

Other officers subdued Spivey.

Miller was treated and released from Lake Forest Hospital.

Spivey was charged with aggravated battery to a corrections officer and faces an additional seven years in prison.

Associate Judge Daniel Shanes ordered him held on $1 million bond, but that figure is irrelevant because Spivey is being held without bond in the Gurnee case.

He is scheduled to appear in court again Oct. 10.
